    my lawyer said it was ok as long as I go back to work for them uon approval. GC is for future job, not current, according to USCIS Director memo.
    The problem is my previous employer is not doing well due to economy :(
    so I might not have a job upon approval
    Please do not imply I am doing something illegal, because it is not that way.

    I keep telling you.
    Neither calculation nor politics works. All this masturbating (sorry for the word but i couldn't found any other word which fits better). FIFO is being applied. It means, we all gotta wait until they clear certain amount of case from Backlog centers. They release the numbers based on the released cases from BC.

    Think that why S.1932 didn't work. Nobody willing to tell the truth but I'm.

    Good luck. My stomach aches when I read this site or look at the cut-off dates.

    Please suggest me good immigration attorney-( in seattle area if possible) for my H1B filing. They should be prompt in preparing my application with in 2 wks time.

    My employer called Rajiv S khanna's law firm. Those para legals said they cannt gaurantee timely filing by april 1st. I think its the busiest law firm in this time of the season. cannt find fault with them any ways.


    I know I am lagging behind a little bit.

    As the clock is ticking, I need to rush up.

    Please suggest me

    When I went for H1B stamping my B1 was cancelled and I was told one can not have more than one visa at the same time.
    I had L1 stamped first and then B1 and both for the same company. Because the company was same in both these cases, thats why there doesnt seem to reason for cancelling my B1. But this time, i am going for H1 stamping from some another company. It is sure that my L1 will get cancelled(because this is company specific visa) but have a doubt about B1.
    Is there any way/process that i can have B1(which i got from existing company) and H1(from new company) at the same time.

    I just got my I-140 approval and my priority date is 02/2008. I fall in the "All Charge-ability Areas Except Those Listed" EB3 and the March bulletin PD is 01MAY05. My lawyer is telling me I cant apply yet and since I am 2 semesters away from completing my Master's I should finish the course and just apply in the EB2 class. I dont have the funds to apply for this whole damn thing all over again. Can someone please help!? I've honestly turned suicidal dealing with this BS..

    IMO: That's the best option to pursue in this situation. Make sure you clearly mention in both I-140/I-485 applications that you have a pending I-140/I-485 (with Receipt Numbers etc). Also send a small write-up along with all the applications explaining the situation and reason for the second filing.

    I would file a separate I-485 and I-140 for this other LC. Experts, what say?

    I do not believe the EAD and AP are tied to the priority date, especially if you have already filed the 485.

    Gurus- correct me if I am wrong.

    I am hearing a lot of cases of RFE. I experienced the same when my best friends case recvd an RFE. They asked all sorts of questions. After filing a reply, there was no update for over a month.
    Eventually, her lawyer re-filed the case with same center, with same set of documents (every single document was the same) under premium processing.

    The same center approved her H-1B in 3 days flat. No questions asked. I guess they are looking for a legal bribe of premium processing fees :D

    Hi my father lost his passport at the airport today and with it his I94 and US B1 visa. We do have scanned copies of his US Visa and Passport. I would appreciate any pointers on the following question -

    1. What are my next steps?
    2. I figured from browsing few sites that he needs to apply for I94 - does any one know of any vague ETA there?
    3. Would he have to go through his visa stamping again?

    I am not sure about the next steps regarding the visa. I guess you might to need to file police complaint about the loss of passport and inform Indian consulate. Did you check the USCIS web site for the visa.

    Hi,

    I am in need of some advice. I am on first h1b extension with 2.5 hears left. I have an MS but was filed under eb3 with priority date of march 2005 (didn't knew about priority categories at that time). Now I am feeling a bit stagnant in my current job, but have always felt myself constrained thinking about restarting the GC process from zero. Given the current eb3 condition and my priority date what would you suggest I should do? Switch job, get a salary raise, restart under eb2 or continue doing whatever I do hoping eb3 will become current in some reasonable time and i'll be free ?

    Thanks for any inputs/thoughts.


    eb3retro, As you may have noticed, this was my first post ever. So I am not aware of what rules you guys have been trying to enforce on this forum. However I like to have my privacy and refuse to share any info that is not pertinent or until I feel comfortable enough. so long .....

    IV does not collect any identifiable information. The information is being requested is all about petitions that you had filed, which no way affects your privacy in my personal opinion. These information will help IV to slice and dice the data and present it to lawmakers when the need arises.

    It is up to you to contribute to these efforts with clean data. I would suggest you to get a paid consultation from an immigration attorney until you become comfortable with IV, people and its forum

    PTs are licensed by the state government. If you are engaged already, you may want to start the licensing process right away because it takes many months and she can get things like transcripts done quicker if she is available locally.

    1. Get her credentials evaluated from FCCPT

    2. Apply for licensing to the state government

    3. Take remedial courses if any are required. This can take few months or many years depending on the course she attended outside the US and the requirements of the state you are looking to live in.

    4. Re-apply for licensing.

    5. Apply for work visa or work on EAD derived from your application.

    Other issues-

    1. You will have to repeat the credential verification and licensing for each state you move to.

    2. States change their licensing requirements all the time, so you may find yourself in a situation where some state in the future refuses to license her because their requirements have changed. Only way to guard against this is to join a DPT or MPT program and get an American credential.

    - The A0XX XXX XXX is the A number or alien number
    - Nothing good or bad. It is sometimes there on the 140 approval notice also. It is there on 485/765/131
    - No one knows when you will get your GC. Your PD is old so you may get lucky soon...

    photoshop is amazing.,.... but if your an artist...like the way painter outputs is really intuitive...the only problem is it has a lot of like variable parts that can seem overwhelming. plus i hate how photoshop doesnt have an add water option like painter. that thing kicks so much ***. I think its a good idea to have both.

    Yes...if they can not prove their viable business and ability to pay....you would have hard time to get the extension.
